Terms of Use

MakeMyReel operates MakeMeFans, including our websites, apps, dashboards, APIs, integrations, automations, and related services. These Terms of Use govern access to and use of the service.

By accessing or using the service, creating an account, connecting a platform account, starting a subscription, or authorizing automation, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

You must be able to form a binding contract under applicable law and be at least the age of majority required for this type of service in your jurisdiction.

If you use the service for a creator, agency, company, or other entity, you represent that you are authorized to bind that person or entity to these terms.

You are responsible for the accuracy of information you provide and for keeping credentials, devices, API connections, and connected platform accounts secure.

You are responsible for all activity through your account unless prohibited by law. You must promptly notify us of unauthorized access, credential compromise, token revocation, or misuse.

Paid access, renewals, taxes, cancellations, refunds, and payment processing may be handled by third-party billing or platform providers. You are responsible for fees, taxes, and charges associated with your use of the service except where required by law or expressly agreed in writing.

If a third-party platform or billing provider suspends, reverses, denies, or changes a charge, subscription, or payout, that issue remains subject to that third party's rules and processes.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use MakeMeFans for your internal business use. We reserve all rights not expressly granted.

Use the service only in compliance with applicable law, these terms, and the rules of connected platforms or providers.

Ensure prompts, automation settings, connected accounts, campaigns, outbound messages, and content are lawful, properly authorized, and appropriate for your business and audience.

Maintain human oversight where needed for legal compliance, brand protection, moderation, customer safety, and platform-rule compliance.

Obtain all rights, permissions, and consents needed for content, data, media, branding, and instructions you submit or connect to the service.

MakeMeFans includes AI-assisted and automation features that may generate messages, recommendations, analytics, classifications, moderation actions, content plans, or operational workflows. Outputs can be incomplete, inaccurate, offensive, unavailable, or unsuitable for a particular context.

You remain responsible for deciding whether to use, review, modify, approve, schedule, or send any output. The service is operational assistance only and is not legal, tax, compliance, employment, accounting, medical, mental-health, or other professional advice.

You retain your rights in content, data, prompts, media, branding, and materials you submit to MakeMeFans. You grant us and our service providers a limited license to host, reproduce, process, transmit, adapt, analyze, and use that material as reasonably necessary to provide, secure, improve, support, and enforce the service and comply with law.

You represent that you have all rights needed to provide that material and authorize those uses. We may refuse, remove, disable, or restrict content where we reasonably believe it creates legal, reputational, security, or operational risk.

You may not use the service for unlawful conduct, fraud, harassment, threats, malware, spam, infringement, deceptive practices, or activity that violates connected platform rules.

You may not use the service to facilitate exploitation, non-consensual sexual content, child sexual abuse material, trafficking, doxxing, impersonation, violent or abusive conduct, or unauthorized access.

You may not reverse engineer, scrape, probe, bypass security, benchmark without permission, or interfere with service integrity, performance, or availability.

The service depends on third-party hosting, model providers, databases, analytics, email services, authentication systems, billing providers, and creator-platform integrations such as Fanvue. We are not responsible for third-party acts, omissions, downtime, policy changes, rate limits, security incidents, or feature removals.

Third-party terms may apply to your use of those services.

We may suspend, throttle, restrict, or terminate access to all or part of the service at any time, with or without notice, if we reasonably believe your use violates these terms, creates legal or security risk, harms other users, threatens providers or infrastructure, or is otherwise necessary to protect the service or comply with law.

You may stop using the service at any time. Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions.

To the fullest extent permitted by law, the service is provided as is, as available, and with all faults. We disclaim warranties, representations, and conditions, whether express, implied, statutory, or collateral, including merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, availability, accuracy, and results.

We do not warrant that the service will be uninterrupted, error-free, secure, or compatible with every workflow, jurisdiction, platform, or device.

To the fullest extent permitted by law, neither MakeMyReel nor its directors, officers, employees, contractors, affiliates, licensors, or service providers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, platform access, or reputational harm arising out of or related to the service.

To the fullest extent permitted by law, our aggregate liability for all claims arising out of or relating to the service will not exceed the greater of amounts you paid us for the service during the 12 months preceding the claim or one hundred US dollars. Nothing in these terms limits liability that cannot be excluded or limited under applicable law.

You will defend, indemnify, and hold harmless MakeMyReel and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your content, use of the service, breach of these terms, violation of law, or infringement or misappropriation of rights.

Unless otherwise required by applicable law, these terms and disputes relating to the service are governed by the laws applicable where the operator maintains its principal place of business, without regard to conflict of laws rules. You agree to submit to the exclusive jurisdiction of courts located there for disputes not required to be resolved elsewhere by law.

We may modify these terms from time to time. The updated version will be posted with a revised effective date. By continuing to use the service after updated terms become effective, you agree to the revised terms. If you do not agree to a material change, you must stop using the service.
